1. PURPOSE OF THIS AGREEMENT

This User Agreement (“Agreement”) governs your conduct, responsibilities, and obligations when using the Smart CV Builder platform (“Platform”).

By creating an account or using the Platform, you agree to comply fully with this Agreement.

This Agreement should be read together with:

  • The Terms of Service
  • The Privacy Policy
  • The Cookie Policy

Smart CV Builder operates as an independent digital service division of Elite CV.

2. USER ELIGIBILITY

You confirm that:

  • You are at least 18 years old.
  • You have legal capacity to enter binding agreements.
  • All information you provide is truthful and accurate.
  • You are using the Platform for lawful professional purposes.

3. USER REPRESENTATIONS AND WARRANTIES

By using the Platform, you represent and warrant that:

  1. All qualifications, certifications, employment history, and professional claims you upload are accurate.
  2. You will not use the Platform to fabricate employment experience.
  3. You will not use the Platform to misrepresent your identity.
  4. You have legal authority to upload all personal information submitted.
  5. Any third-party data uploaded has been provided with lawful consent.

You acknowledge that providing false information may expose you to civil or criminal liability independent of this Platform.

4. PROHIBITED USES

You may not use Smart CV Builder to:

  • Create fraudulent CVs or resumes
  • Falsify employment history
  • Generate documents for immigration fraud
  • Impersonate another individual
  • Misrepresent academic qualifications
  • Generate forged reference details
  • Upload copyrighted content you do not own
  • Submit malicious code or harmful files
  • Attempt to reverse engineer the Platform
  • Use automated scraping tools

Any such activity may result in immediate termination of access.

5. AI-GENERATED CONTENT RESPONSIBILITY

Smart CV Builder uses automated AI systems to generate professional content.

You acknowledge that:

  • AI-generated content is based on algorithmic processing.
  • The Platform does not independently verify factual accuracy.
  • You are solely responsible for reviewing all generated content.
  • The Company is not responsible for employment consequences arising from inaccurate or misleading information.

AI output is an assistance tool, not a substitute for professional judgment.

6. PROFESSIONAL ETHICS AND MISREPRESENTATION

You agree that you will not:

  • Present generated content as endorsed by Smart CV Builder.
  • Use the Platform to deceive employers.
  • Attribute AI-generated wording to specific human authors.
  • Claim that the Platform guarantees job placement.

Smart CV Builder does not participate in recruitment decisions.

7. DATA USAGE ACKNOWLEDGEMENT

You understand that:

  • Your uploaded information is processed for CV generation.
  • Processing may occur via automated systems.
  • Data may be stored temporarily for service delivery.
  • You may request deletion subject to applicable laws.

All processing is governed by our Privacy Policy and applicable legislation including:

  • Protection of Personal Information Act
  • General Data Protection Regulation (where applicable)

8. ACCOUNT SECURITY

You are responsible for:

  • Maintaining confidentiality of login credentials.
  • All activity occurring under your account.
  • Immediately notifying us of suspected unauthorized access.

The Company is not liable for losses caused by compromised credentials due to user negligence.

9. INTELLECTUAL PROPERTY RIGHTS

9.1 User Content

You retain ownership of information you upload.

You grant Smart CV Builder a limited license to:

  • Process
  • Format
  • Generate output
  • Store for service provision

9.2 Platform Ownership

All templates, layouts, AI prompts, design systems, and technical structures remain the exclusive property of the Company.

You may not:

  • Replicate template designs for resale
  • Use output as part of competing software
  • Extract template structures for commercial use

10. INDEMNIFICATION

You agree to indemnify and hold harmless Smart CV Builder and its operators against claims arising from:

  • False information submitted by you
  • Fraudulent job applications
  • Misuse of generated documents
  • Violation of employment laws
  • Disputes between you and third parties

11. LIMITATION OF PLATFORM LIABILITY

Smart CV Builder:

  • Does not guarantee job interviews.
  • Does not guarantee employment outcomes.
  • Is not liable for employer decisions.
  • Is not liable for rejection or reputational harm resulting from user misrepresentation.

To the extent permitted by law, liability is limited to fees paid for the service within the previous 12 months.

Nothing in this Agreement excludes liability where prohibited by law.

12. TERMINATION AND SUSPENSION

We may suspend or terminate access if:

  • You violate this Agreement.
  • You engage in fraudulent conduct.
  • You upload unlawful content.
  • You attempt to compromise system security.

Termination may occur without prior notice in cases of serious breach.

13. GOVERNING LAW

This Agreement is governed by the laws of the Republic of South Africa.

Where applicable, disputes may be resolved in accordance with:

  • Electronic Communications and Transactions Act
  • Consumer Protection Act

Users outside South Africa may also be subject to local laws.

14. DISPUTE RESOLUTION

Parties agree to attempt resolution through good-faith negotiation before initiating legal proceedings.

If unresolved, disputes shall be submitted to competent courts within South Africa.

15. MODIFICATIONS

We reserve the right to update this Agreement at any time.

Continued use of the Platform constitutes acceptance of updated terms.
