ACCEPTABLE USE POLICY (AUP)

1. PURPOSE
This Acceptable Use Policy (“AUP”) sets out the rules governing how users may access and use the Smart CV Builder platform (“Platform”).
This Policy forms part of and should be read together with:
- The Terms of Service
- The User Agreement
- The Privacy Policy
By accessing or using the Platform, you agree to comply with this AUP.
2. LAWFUL USE ONLY
You may use Smart CV Builder only for lawful professional purposes.
You may not use the Platform in any way that:
- Violates applicable laws or regulations
- Infringes the rights of others
- Facilitates deception, fraud, or misrepresentation
This includes compliance with:
- Protection of Personal Information Act
- Electronic Communications and Transactions Act
- Consumer Protection Act
3. PROHIBITED CONTENT
You may not upload, generate, request, or distribute content that:
3.1 Fraudulent Content
- Fabricates employment history
- Falsifies academic qualifications
- Invents certifications or licenses
- Creates forged references
- Misrepresents professional experience
3.2 Identity Misuse
- Impersonates another individual
- Uses another person’s personal information without consent
- Submits stolen CV content
3.3 Illegal or Unlawful Material
- Encourages criminal activity
- Assists with visa or immigration fraud
- Contains malicious code or harmful files
3.4 Offensive or Harmful Content
- Hate speech
- Harassment
- Discriminatory or defamatory statements
- Content that violates human dignity
4. AI MISUSE PROHIBITION
Smart CV Builder uses AI-driven systems to assist with CV generation.
You may not:
- Attempt to manipulate the AI system to generate deceptive or misleading credentials
- Use the Platform to reverse-engineer AI prompts or system logic
- Extract template structures for resale or competing products
- Use automated scraping or bots to mass-generate content
AI output is intended to support professional presentation, not to create false professional identities.
5. DATA PROTECTION AND THIRD-PARTY INFORMATION
You may only upload personal information that:
- Belongs to you; or
- You have explicit legal authority to use
You may not:
- Upload sensitive personal data of third parties without consent
- Use the Platform to store personal data unrelated to CV generation
- Process employee data without lawful authority
Misuse of personal data may result in termination and potential legal reporting.
6. SECURITY RESTRICTIONS
You may not:
- Attempt to access restricted areas of the Platform
- Interfere with server infrastructure
- Introduce malware or malicious scripts
- Conduct denial-of-service attacks
- Circumvent authentication mechanisms
We monitor for suspicious technical activity.
7. INTELLECTUAL PROPERTY PROTECTION
You may not:
- Copy Smart CV Builder templates for resale
- Replicate platform design elements
- Reproduce proprietary formatting systems
- Use generated outputs to build competing SaaS products
All platform architecture remains the intellectual property of Smart CV Builder.
8. EMPLOYMENT ETHICS DISCLAIMER
The Platform does not:
- Endorse fabricated credentials
- Guarantee employment
- Participate in recruitment decisions
Users remain solely responsible for the accuracy of documents submitted to employers.
9. ENFORCEMENT
If we reasonably believe you have violated this AUP, we may:
- Suspend or terminate your account
- Delete generated content
- Restrict access without notice
- Report unlawful activity to relevant authorities
Serious breaches may result in permanent banning.
10. REPORTING ABUSE
If you become aware of misuse of the Platform, please report it to:

1. Who This Policy Applies To
This Acceptable Use Policy applies to all users of Smart CV Builder, including:
- Visitors who browse the site without registering
- Registered users who have created a free account
- Paying customers who have purchased any of our products
- Anyone who uses our free ATS CV Scanner tool
Smart CV Builder is operated by Elite CV, Sandton, Johannesburg, Gauteng, 2196.
2. Permitted Use
Smart CV Builder is designed and licensed for personal, non-commercial use. Specifically, you are permitted to:
- Create, edit, save, and download your own personal CV and cover letter documents
- Use the free ATS CV Scanner to analyse your own CV and cover letter
- Access your saved documents from your account at any time
- Use the documents you create for legitimate personal job-seeking purposes

Any use of Smart CV Builder beyond what is described above requires our prior written consent. If you are unsure whether a particular use is permitted, please contact us before proceeding.
3. Prohibited Conduct
The following activities are strictly prohibited on Smart CV Builder. These categories are not exhaustive the underlying principle is that any use that harms other users, our platform, or third parties is prohibited.
🚫 Fraudulent & Deceptive Activity
- Creating CVs that contain false qualifications, fabricated employment history, or misrepresented credentials
- Impersonating another person by creating a CV in their name without their consent
- Using Smart CV Builder to assist others in committing CV fraud
- Submitting fraudulent payment information or attempting to circumvent our payment system
🚫 Unlawful Activity
- Using the platform in any way that violates South African law or applicable international law
- Using Smart CV Builder to process or store stolen personal information
- Creating documents intended to facilitate money laundering, human trafficking, or any other criminal activity
- Any activity that constitutes an offence under the Cybercrimes Act 19 of 2020
🚫 Platform Abuse
- Automated scraping, crawling, or bulk extraction of any content, templates, or data from our platform
- Using bots, scripts, or automated tools to interact with Smart CV Builder without our written permission
- Attempting to gain unauthorised access to any user account, admin area, or backend system
- Interfering with or disrupting the platform, servers, or networks connected to our service
- Placing an excessive or unreasonable load on our infrastructure
🚫 Reverse Engineering & Copying
- Attempting to decompile, reverse engineer, or extract the source code of any part of our platform
- Copying, reproducing, or distributing our CV templates, designs, or software without written permission
- Reselling or sublicensing access to Smart CV Builder or our templates to third parties
- Creating competing products or services using content or methods derived from Smart CV Builder
🚫 Security Violations
- Probing, scanning, or testing the vulnerability of our systems without authorisation
- Introducing malware, ransomware, viruses, trojans, or any other harmful code
- Attempting to intercept or eavesdrop on communications between users and our platform
- Attempting to bypass, disable, or circumvent any security or authentication mechanism
🚫 Misuse of Personal Data
- Creating CVs or cover letters containing another person's personal information without their explicit consent
- Using the platform to collect, harvest, or compile personal information about other users
- Uploading or processing personal information of minors without verifiable parental consent
- Any activity that constitutes a violation of POPIA or other applicable data protection law
4. Content Standards
You are solely responsible for all content you create, upload, or submit through Smart CV Builder. Your content must not:
- Be false, misleading, or fraudulent
- Infringe the intellectual property rights, privacy rights, or any other rights of any person
- Be defamatory, threatening, harassing, or discriminatory on the basis of race, gender, religion, nationality, disability, sexual orientation, or any other protected characteristic
- Violate any applicable South African law, including but not limited to the Promotion of Equality and Prevention of Unfair Discrimination Act
- Contain personal information about third parties that you are not authorised to use or disclose
While we do not routinely review user-generated CV content, we reserve the right to remove content and suspend accounts where we become aware of a violation of these standards.
5. Platform Integrity
Account sharing
Your Smart CV Builder account is for your personal use only. You may not share your login credentials with others or allow third parties to access your account. Each individual user must create their own account.
Commercial use
Smart CV Builder is licensed for personal, individual use. You may not use our platform commercially for example, by charging others to create their CVs using our tools, or by operating a CV writing service using our platform without a separate written commercial licence agreement with Elite CV. Accurate account information
You must provide accurate and truthful information when creating your account and must keep your account details up to date. Providing false account information including a false name or email address is a violation of this policy.
6. Intellectual Property
All templates, designs, software, branding, and platform content are the exclusive intellectual property of New Elite Holdings (Pty) Ltd. Your permitted use of Smart CV Builder does not grant you any ownership rights over any part of our platform.
You may use the CV and cover letter documents you create as final output files freely for personal job-seeking purposes. However, the underlying templates, layouts, and design systems remain our property and may not be extracted, copied, or repurposed outside of the documents you generate.
If you believe any content on Smart CV Builder infringes your intellectual property rights, please notify us at [email protected] with full details of your claim.
7. Consequences of Violation
We take violations of this Acceptable Use Policy seriously. Depending on the nature and severity of the violation, we may take one or more of the following actions:
Written Warning
For minor or first-time violations, we may issue a written warning requiring immediate correction of the violating behaviour.
Temporary Suspension
We may suspend your account temporarily while we investigate a suspected violation. You will be notified by email.
Permanent Termination
For serious or repeated violations, we will permanently terminate your account without notice and without refund of any amounts paid.
Content Removal
We may remove any content that violates this policy, applicable law, or the rights of third parties.
Legal Action
For violations involving fraud, security breaches, intellectual property theft, or criminal activity, we reserve the right to pursue civil or criminal legal remedies and to report the matter to the South African Police Service or relevant regulatory authority.
8. Reporting a Violation
If you become aware of any activity on Smart CV Builder that you believe violates this Acceptable Use Policy including suspected fraud, security incidents, or misuse of personal data — please report it to us promptly.
