Smart CV Builder is an online CV and cover letter creation service operated by Elite CV ("Elite CV", "we", "us", "our"), a private company registered in the Republic of South Africa.

These Terms govern your use of the Smart CV Builder website and all related products and services, including the free ATS CV Scanner, the paid CV Builder, Cover Letter Builder, and Combo products.

To use Smart CV Builder, you must:

• Be at least 18 years of age, or be at least 13 years of age with the verifiable consent of a parent or legal guardian
• Have the legal capacity to enter into a binding contract under South African law
• Provide accurate, truthful, and complete registration information
• Not be prohibited by applicable law from accessing or using our services

By creating an account, you represent and warrant that you meet these eligibility requirements.

Registration

To access paid features or to save and re-edit your CV, you must create an account. You agree to provide accurate and complete information and to keep your account details up to date.

Account security

You are responsible for maintaining the confidentiality of your login credentials. You must not share your password with anyone. You agree to notify us immediately at [email protected] if you suspect any unauthorised use of your account.

Elite CV will not be liable for any loss or damage arising from your failure to keep your account credentials secure.

Account accuracy

You are solely responsible for all activity that occurs under your account. You must ensure that the information you enter into your CV and cover letter is accurate. Elite CV does not verify the accuracy of user-entered CV content.

Free services

The Free ATS CV Scanner is available to all visitors without payment. It analyses your CV and/or cover letter against ATS criteria and provides recommendations. This is a freemium tool designed to help you understand your CV's compatibility with applicant tracking systems.

Paid services

All prices are quoted in South African Rand (ZAR). Elite CV is not currently VAT-registered; therefore no VAT is charged on these amounts.

Access after payment

Upon successful payment, you will receive immediate access to your purchased product(s). You may log in at any time to re-edit and re-download your CV and/or cover letter at no additional charge.

Service availability

We aim to provide uninterrupted access to Smart CV Builder but do not guarantee 100% uptime. Scheduled maintenance will be communicated where possible. We are not liable for losses arising from temporary unavailability.

No guarantee of employment outcomes

Smart CV Builder provides tools to help you create professional CV and cover letter documents. We make no representations or warranties that use of our service will result in job interviews, employment offers, or any particular career outcome. Employment decisions are made by third-party employers and are entirely outside our control.

Once-off payment model

Smart CV Builder operates on a pay-per-use, once-off payment model. There are no recurring subscriptions or monthly charges. You pay once per product and retain access to that product (including re-editing capability) for as long as your account remains active.

Payment processing

All payments are processed securely by PayFast, a registered South African payment service provider. Card details and banking information are entered directly on PayFast's secure platform and are never stored by Elite CV. PayFast's terms and privacy policy apply to the payment transaction.

Order confirmation

Upon successful payment, you will receive a confirmation email. Please keep this for your records. If you do not receive a confirmation within 30 minutes, please check your spam folder or contact us at [email protected].

Failed payments

If your payment is unsuccessful, access to the paid product will not be granted until payment is confirmed. Please contact us if you believe a payment error has occurred.

Price changes

We reserve the right to adjust our pricing at any time. Price changes will be updated on our website and will apply to new purchases only. Previously paid transactions are not affected.

Our intellectual property

The Smart CV Builder platform, software, code, CV templates, design elements, branding, logos, text, and all other content and materials on the website are the exclusive intellectual property of New Elite Holdings (Pty) Ltd or its licensors and are protected by South African and international copyright, trademark, and intellectual property laws.

You may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works from any part of our platform, templates, or materials without our prior written consent.

Your intellectual property

The content you create using Smart CV Builder your CV text, work history, personal summary, and cover letter belongs to you. You retain full ownership of your content at all times.

Licence you grant us

By using Smart CV Builder, you grant Elite CV, non-exclusive, royalty-free licence to store, process, and display your content solely for the purpose of providing the service to you. We do not use your CV content for any other purpose, including marketing, AI training, or sharing with third parties, except as described in our Privacy Policy.

You are solely responsible for the accuracy, completeness, and legality of the content you enter into your CV and cover letter. You warrant that:

• All information you provide is truthful and accurate to the best of your knowledge
• Your content does not infringe the intellectual property rights of any third party
• Your content does not contain any unlawful, defamatory, discriminatory, or harmful material
• You will not use Smart CV Builder to create fraudulent CVs or misrepresent your qualifications

Elite CV does not review, edit, or verify user-generated CV content and accepts no liability for the accuracy or consequences of the content you create.

You agree not to use Smart CV Builder in any way that:

• Violates any applicable South African law or regulation
• Infringes the rights of any other person or entity
• Involves scraping, crawling, or automated extraction of data from our platform
• Attempts to gain unauthorised access to any part of our systems or another user's account
• Introduces malware, viruses, or any other harmful code
• Impersonates any person or entity
• Involves the resale or commercialisation of our templates or tools without written permission
• Attempts to reverse engineer or decompile any part of our software
• Places an unreasonable or excessive load on our infrastructure

We reserve the right to suspend or terminate any account found to be in breach of this Acceptable Use Policy, without prior notice and without refund.

Service provided "as is"

Smart CV Builder is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable South African law, we make no warranties express or implied regarding the service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the maximum extent permitted by the Consumer Protection Act and applicable law, Elite CV's total liability to you for any claim arising from your use of Smart CV Builder shall not exceed the amount you paid for the specific product giving rise to the claim.

Elite CV is not liable for any indirect, incidental, consequential, or special damages arising from your use of or inability to use the service, including loss of data, loss of employment opportunity, or economic loss.

As a consumer, you are protected by the Consumer Protection Act 68 of 2008. The following rights apply to your use of Smart CV Builder:

Right to quality service

You are entitled to receive services that are performed with reasonable care and skill. If the service is not of acceptable quality, you may request that we remedy the issue.

Right to cooling-off (direct marketing)

If you purchased a product as a direct result of unsolicited direct marketing (e.g. you received an unsolicited email or SMS and purchased immediately as a result), you have the right to cancel within 5 business days and receive a full refund. This right is separate from our standard refund policy below.

Right to transparent pricing

All prices are displayed in full in ZAR before you complete your purchase. There are no hidden charges.

Right to plain language

We are required to present our agreements in plain and understandable language, which we endeavour to do throughout these Terms.

Complaints

If you have a complaint, please contact us first at [email protected]. If we are unable to resolve your complaint satisfactorily, you may refer the matter to the National Consumer Commission at www.thencc.org.za or the Consumer Goods and Services Ombud at www.cgso.org.za.

Termination by you

You may close your account at any time by contacting us at [email protected]. Upon closure, your CV and cover letter data will be deleted within 30 days in accordance with our Privacy Policy. Please download any documents you wish to keep before requesting account closure.

Termination by us

We reserve the right to suspend or terminate your account immediately if:

• You breach these Terms and Conditions
• We reasonably suspect fraudulent activity
• You use the service for any unlawful purpose
• Your conduct puts other users or our systems at risk

Where we terminate your account due to a material breach on your part, no refund will be due. Where termination is not due to your breach, we will consider a pro-rata refund of any amounts paid.

We may update Smart CV Builder, add or remove features, or change these Terms from time to time. When we make material changes to these Terms, we will:

• Update the "Last Updated" date at the top of this page
• Display a prominent notice on our website
• Notify registered users by email where the changes are significant

Your continued use of Smart CV Builder after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the service.

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa.

Any dispute arising from or relating to these Terms or your use of Smart CV Builder shall first be referred to informal resolution by contacting us at [email protected]. We will endeavour to resolve disputes within 10 business days.

If informal resolution is unsuccessful, the dispute shall be subject to the jurisdiction of the South Gauteng High Court, Johannesburg, or the Magistrate's Court having jurisdiction, at our election.

Nothing in this clause prevents you from referring a consumer dispute to the National Consumer Commission, the Consumer Goods and Services Ombud, or any other applicable regulatory body.

Entire agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Elite CV regarding your use of Smart CV Builder and supersede all prior agreements.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.

Waiver

Our failure to enforce any provision of these Terms on any occasion shall not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor in the event of a business sale or restructuring.

Force majeure

We are not liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including load-shedding, internet outages, natural disasters, or acts of government.
